Looks like a bug that's been there since the command spell was introduced in 4.2.0. I'll request a change in the nightly version that will have the spell take mana and a turn when the monster makes its saving throw against the spell.
What is the point of necromancer's command spell having a chance of being resisted?
As far as I can tell, command being resisted doesn't actually take up a turn, nor does it remove any SP, so I would just sit there repeating the spell until it works.
