It's set to your system's clock. Change your date to 12/25 if u want a hassle free present, or 12/24 if you want to experience the Christmas curse by opening early.

I can't recall when they 'go live'... 12/21?

Every new character during that time frame gets a present. Its kind of fun to open the present, then suicide and do it again. Present scumming is fun and is not to be missed. I recommend trying the Christmas curse by opening a present early. Basically, you roll everything twice and take the lower of the results, same as the 3 Sil curse... but in the opening stages of the game it's rather brutal. Enjoy!
